Blogger Contest Official Rules
NO PURCHASE NECESSARY. A PURCHASE OR PAYMENT OF ANY KIND WILL NOT INCREASE YOUR CHANCES OF WINNING.
Content Overview: The CVS Pharmacy, Inc. People’s Choice Awards Contest (the “Contest”) is designed to create “beauty buzz” around the upcoming People’s Choice Awards, airing January 11, 2012. By receiving an invitation to participate in the Contest, you are being asked to create a one-minute “Get the Look” haul/demo video. Participants in the contest will receive the compensation described in Section 3 of the Participant Agreement. In addition, participants will be judged to determine who will win a trip for two to the 2012 People’s Choice Awards. These Official Rules are to be read in conjunction with, and are hereby incorporated in to, the Participant Agreement to which these Official Rules have been attached.
Eligibility: The Contest is open only to those specific individuals who have been invited by the Sponsor. Members of the public may participate in the Contest through voting, but no other means of participation will be available to people who were not invited to participate.

Participant Video Conditions: To the extent that any video submitted by a participant violates any of the Content Guidelines (listed below), Sponsor reserves the right to disqualify that participant, remove the video from the Contest, and take any other action as may be required to protect Sponsor, any third party, or any rights belonging to either Sponsor or a third party.
The videos must not:
- Contain material that violates or infringes another’s rights, including but not limited to privacy, publicity or intellectual property rights, or that constitutes copyright infringement;
- Disparage Sponsor or any person or party affiliated with the promotion and administration of this Contest;
- Feature brand names or trademarks other than those approved by Sponsor;
- Contain text or imagery that is inappropriate, indecent, obscene hateful, tortious, defamatory, slanderous or libelous;
- Contain text or imagery that promotes bigotry, racism, hatred or harm against any group or individual or promotes discrimination based on race, gender, religion, nationality, disability, sexual orientation or age; and
- Contain material that is unlawful, in violation of or contrary to the laws or regulations in any jurisdiction where submission is created.
All participants who have submitted a video to the Sponsor will have their videos uploaded to www.peopleschoice.com/cvs (the "Website"). Once the videos have been uploaded to the Website, members of the general public may vote for their favorite video. Visitors to the Website will be asked to vote for the video that they think has the "best look" — that is, portrays the sense of style, fashion, and beauty that they find most appealing.
The winner will be the participant whose video receives the most votes as of December 6, 2011. The Website’s computer will be the official timekeeping device of this Contest. In the event of a tie, the winner will be the participant who achieved the vote total first in time. If for whatever reason Sponsor is unable to determine a winner through this procedure, Sponsor reserves the right to select a panel of judges who will select the winner from among the tied participants by using the following criteria: 50% creativity and originality; 25% portray of style, fashion, and beauty, and 25% substance of the post (quality of the content, means employed to disseminate/teach blog readers, etc.).
Voting will be managed by Procter and Gamble Productions, Inc. and/or its affiliates or subsidiaries, who administer the Website. Voting will be handled in accordance with the Website’s Terms and Conditions, which are hereby incorporated by reference in to these Official Rules. Terms and Conditions for the Website can be found here: http://www.peopleschoice.com/pca/terms.jsp. In other words, winner selection in the Contest will proceed just as if the Contest were a part of the People’s Choice Awards, except no on-stage award or presentation will be given. Rather, the winner will be notified by e-mail, telephone call, text message, or letter from Sponsor and/or Administrator. The notification will include a time period during which the selected winner must acknowledge the notification and provide Sponsor with any requested documentation. This may include, without limitation, an Affidavit of Eligibility/Release of Liability for any and all claims related to or arising from the selected winner’s participation in the Contest. Failure to acknowledge the prize notification and/or return to Sponsor any information or documentation requested by Sponsor may result in disqualification of the participant. If the prize winner is disqualified for any reason, an alternate prize winner may be selected by Sponsor according to the procedure outline above.
The contest winner will receive:
A trip for two (2) people to the 2012 People’s Choice Awards: Trip package will include:
- Round trip airfare for winner and guest from a major airport near the winner’s home to a major airport near Los Angeles (airports chosen by Sponsor; Sponsor reserves the right to make alternate travel arrangements for guest if Sponsor deems this to be in the best interests of Sponsor);
- Transportation to and from airport for winner and guest.
- Hotel accommodations for winner and guest (2 standard rooms, single occupancy for each room);
- Two (2) tickets to the People’s Choice Awards ceremony;
- Transportation to and from the People’s Choice Awards for winner and guest;
- Limited styling will be provided by Sponsor, however winner and guest must provide their own clothing. Stylist will be selected by Sponsor in its sole discretion;
- Additional publicity on peopleschoice.com with footage captured by winner on red carpet, to be submitted post show, as is detailed in the Participant Agreement.
Prize Conditions: Winner and guest must be able to travel to Los Angeles on the dates specified by Sponsor (on or around January 11, 2012). If winner and/or guest cannot travel on these dates, the prize will be forfeit. Approximate retail value of prize package: $5,000. Travel restrictions, conditions and limitations may apply. Specific seat locations will be determined by Sponsor in its sole discretion. Travel must be roundtrip. Sponsor will determine airline and flight itinerary in its sole discretion. No refund or compensation will be made in the event of the cancellation or delay of any flight. Travel and accommodations are subject to availability. Travel is subject to the terms and conditions set forth in these Official Rules, and those set forth by the Sponsor’s airline carrier of choice as detailed in the passenger ticket contract. All expenses and incidental travel costs not expressly stated in the package description above, including but not limited to, ground transportation to/from winner’s home to the airport, meals, incidentals, passenger tariffs or duties, airline fees, surcharges, airport fees, service charges or facility charges, personal charges at lodging, security fees, taxes or other expenses are the responsibility solely of winner. Sponsor will not replace any lost, mutilated, or stolen tickets, travel vouchers or certificates. Sponsor is not responsible if the event included in the prize package is delayed, postponed or cancelled for any reason, in which event that portion of prize is forfeited in its entirety and no substitution will be provided except as in Sponsor’s sole discretion. In the event that winner or guest lives within one hundred (100) miles of Los Angeles, Sponsor will provide that winner and/or guest with round trip ground transportation between the person’s home and the hotel in lieu of the round trip coach air transportation from major commercial airport near the winner’s residence. In the event that winner and/or guest lives within twenty five (25) miles of the event site, Sponsor reserves the right to provide daily roundtrip transportation for winner and/or guest between that person’s home and the event site in lieu of awarding air travel and hotel accommodations. Winner’s guest be awarded the same things as winner – winner’s guest will not be awarded air travel or hotel accommodations if winner is not similarly awarded such items, unless Sponsor decides, in its sole discretion, to do otherwise. The value difference between the round trip coach air transportation/hotel accommodations and ground transportation options (as the case may be) will not be provided. Winner and guest will be required to provide a valid major credit card or some other acceptable form of payment, as determined in the hotel’s sole discretion upon hotel check and all in-room charges, telephone calls, meals, beverages, gratuities, hotel upgrades, amenities, personal incidentals and any other expenses charged to the winner’s hotel room will be charged to that major valid credit card or deducted from the deposit provided. Guest of winner must be at least eighteen (18) years old. Approximate Retail Value of the travel package may vary based on the commercial airport near winner’s permanent residence, as well as hotel fluctuations at the time of travel. Any difference between stated ARV and actual value of the prize as awarded will not be awarded. Winner and guest will be solely responsible for obtaining all required government documents in order to travel. Failure to obtain any required documents (e.g., government issued identification, passport, travel visa, etc.) will result in disqualification of the winner and/or guest (as may be appropriate), and the prize will be awarded to another participant. If the winner is disqualified, the winner’s guest will not receive any part of the prize package. Sponsor shall not be liable for any loss or damage to baggage. Prize and prize components are non-transferable and no substitution or cash redemption will be permitted unless Sponsor, in its sole discretion, determines otherwise. Sponsor reserves the right to substitute a prize (or portion thereof) with one of comparable or greater value, at its sole discretion. Winner and guest are responsible for all federal, state, provincial, territorial, municipal and local taxes and any other costs, expenses or fees associated with prize acceptance and/or use not specified herein as being provided. All prize details are at Sponsor’s sole discretion.
Release: By receipt of any prize, winner agrees to release and hold harmless Sponsor, and its subsidiaries, affiliates, suppliers, distributors, advertising/promotion agencies, and prize suppliers, and each of their respective parent companies and each such company’s officers, directors, employees and agents (collectively, the “Released Parties”) from and against any claim or cause of action, including, but not limited to, personal injury, death, or damage to or loss of property, arising out of participation in the Contest or receipt or use or misuse of any prize.
General Conditions: Sponsor reserves the right to cancel, suspend and/or modify the Contest, or any part of it, if any fraud, technical failures or any other factor beyond Sponsor’s reasonable control impairs the integrity or proper functioning of the Contest, as determined by Sponsor in its sole discretion. Sponsor reserves the right, in its sole discretion, to disqualify any individual it finds to be tampering with the entry process or the operation of the Contest or to be acting in violation of these Official Rules or any other promotion or in an unsportsmanlike or disruptive manner. Any attempt by any person to deliberately undermine the legitimate operation of the Contest may be a violation of criminal and civil law, and, should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.
Limitations of Liability: The Released Parties are not responsible for: (1) any incorrect or inaccurate information, whether caused by entrants, printing errors or by any of the equipment or programming associated with or utilized in the Contest; (2) technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software; (3) unauthorized human intervention in any part of the entry process or the Contest; (4) technical or human error which may occur in the administration of the Contest or the processing of entries; (5) late, lost, undeliverable, damaged or stolen mail; or (6) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the Contest or receipt or use or misuse of any prize. If for any reason an entrant's entry is confirmed to have been erroneously deleted, lost, or otherwise destroyed or corrupted, entrant’s sole remedy is another entry in the Contest, provided that if it is not possible to award another entry due to discontinuance of the Contest, or any part of it, for any reason, Sponsor, in its sole discretion, initiate the judging and voting procedure will all submissions received up to that time.
